1. Eligibility for Visa & Mastercard Gift Card Redemption by Minors (Users Under 18 Years of Age)

AdvitCare Rewards Program ("Program") permits users who are minors (individuals under the age of 18) to redeem earned points ("points") for Visa or Mastercard gift cards, subject to the terms outlined in this policy and our general Terms of Service.

Legal Basis and Parental/Guardian Involvement:

Legally, contracts with minors are often voidable by the minor. To ensure a valid and enforceable redemption process when Visa or Mastercard gift cards are chosen by a user under 18, [AdvitCare Rewards Program] implements the following:

Parental/Guardian Consent and Agreement: By allowing a minor to participate in the Program and redeem Rewards for Visa or Mastercard gift cards, the parent or legal guardian of the minor ("Parent/Guardian") acknowledges and agrees to the following:

They have reviewed and consented to the minor's participation in the Program and this specific redemption policy.

They understand that Visa and Mastercard gift cards are cash-equivalent instruments and come with their own terms and conditions set by the card issuer, which they and the minor agree to abide by.

The Parent/Guardian hereby agrees to be fully responsible for all activities of the minor within the Program, including the redemption of Rewards for Visa or Mastercard gift cards and the subsequent use of such gift cards.

The Parent/Guardian agrees to supervise the minor's use of any redeemed Visa or Mastercard gift card.

The Program relies on the Parent/Guardian's consent for the minor's actions. The redemption of a Visa or Mastercard gift card by a minor, and the subsequent use of that card, will be deemed to be under the supervision and with the explicit consent of the Parent/Guardian.

Verification: The Program may require verification of parental/guardian consent before a Visa or Mastercard gift card redemption by a minor is processed. This may include, but is not limited to, requiring the Parent/Guardian to create an account, confirm their relationship to the minor, or provide explicit consent through a verifiable mechanism.

2. Cautions and Responsibilities:

Issuer Terms and Conditions: All Visa and Mastercard gift cards are issued by third-party financial institutions and are subject to the terms and conditions set forth by the issuer. These terms may include activation procedures, fees (e.g., inactivity fees, purchase fees if applicable at redemption – though ideally your program absorbs these), expiration dates, and usage restrictions. It is the responsibility of the minor and their Parent/Guardian to read and understand the specific terms and conditions accompanying any redeemed gift card. The Program is not responsible for the terms set by the card issuer.

Lost or Stolen Cards: Once a Visa or Mastercard gift card is redeemed and issued, the Program is not responsible for lost, stolen, or damaged gift cards, nor for any unauthorized use of the gift card. Safeguarding the gift card and its details is the responsibility of the minor and their Parent/Guardian. Some card issuers may offer protections or replacement services, which would be governed by their specific policies.

Usage Restrictions: Visa and Mastercard gift cards can generally be used wherever Visa or Mastercard debit cards are accepted. However, some merchants may have policies restricting their use by minors for certain types of purchases (e.g., age-restricted goods or services). The Program is not responsible for any such merchant restrictions.

Data Privacy: The collection and use of a minor's personal information by the Program are governed by our Privacy Policy. For users under the age of 13, specific parental consent for data collection and use will be obtained in accordance with the Children's Online Privacy Protection Act (COPPA) or other applicable laws. The redemption of Visa or Mastercard gift cards may require the provision of certain personal information (e.g., email) which will be handled in accordance with our Privacy Policy and applicable laws.

Disputes: Any disputes related to the functionality or use of a Visa or Mastercard gift card after redemption should be directed to the card issuer, as per their terms and conditions.

Program Discretion: The Program reserves the right to modify this policy or to place limits or additional conditions on the redemption of Visa or Mastercard gift cards by minors at its sole discretion and in accordance with applicable laws.

3. How it Works (Simplified for Minors and Parents/Guardians):

Earn Rewards: The user (minor) participates in the AdvitCare Rewards Program and earns points.

Choose Reward: The user selects a Visa or Mastercard gift card from the rewards catalog. We allow only up to 30$ for minors!

Parent/Guardian Confirmation (If/When Required): Before the gift card is issued, we may need your Parent or Guardian to confirm they agree to this redemption. They are agreeing to be responsible for your use of the card.

Receive Card: The gift card (or its details, if virtual) is delivered.

Use Card: The gift card can be used where Visa or Mastercard is accepted, but remember to check the card's own rules (terms and conditions) that come with it. Your Parent/Guardian should help you understand these.

By redeeming Rewards for a Visa or Mastercard gift card, both the minor user and their Parent/Guardian (on behalf of themselves and the minor) affirm that they have read, understood, and agreed to this policy and the Program's general Terms of Service.
